U.S. President Donald J. Trump has signed into law H.J. Res. 61, a resolution that nullifies the Environmental Protection Agency’s (EPA) rule concerning “National Emission Standards for Hazardous Air Pollutants: Rubber Tire Manufacturing.” This Congressional Review Act (CRA) resolution effectively overturns the EPA’s Rubber Tire Manufacturing National Emissions Standards for Hazardous Air Pollutants (NESHAP) rule.
The NESHAP rule was finalized on November 29, 2024, during the Biden Administration. It required rubber tire manufacturers to install regenerative thermal oxidizers (RTOs), which could cost American manufacturers millions and potentially lead to layoffs. The EPA had not quantified whether public health would be protected by this regulation.
Congressman Morgan Griffith of Virginia, who sponsored the CRA resolution in the House, expressed satisfaction with its enactment. He stated, “I am pleased President Trump signed my Congressional Review Act resolution into law! Americans are now officially protected from a last-minute Biden-Harris rule that would have needlessly harmed the tire manufacturing industry and raised prices for American consumers.”
Rep. Griffith introduced H.J. Res. 61 in late February alongside U.S. Senators Tim Scott and Roger Wicker. The U.S. House of Representatives passed it on March 5 after Rep. Griffith defended it on the House floor and celebrated its passage with GOP leaders.
The U.S. Senate approved the measure on May 6, leading to its final approval by President Trump.
Additionally, Rep. Griffith has defended several CRAs aimed at overturning other Biden EPA measures related to electric vehicle mandates and stricter car emissions standards.
